When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

2 RepliesI had my EB-2 visa interview in mid-August. At the time, my medical exam wasn t complete, so the consular officer gave me a 221(g). I ve since finished the medical, submitted the results, and returned my passport to the consulate.
Now, as of early September, the Department of State has announced that the annual EB-2 visa limit for FY2025 has been reached:

If anyone has been in a similar situation; especially with a 221(g) that was resolved around the same time the cap was hit; I d really appreciate hearing how your case turned out.

I was hoping to get some advice on a situation. I m a green card holder and filed for my wife s green card under the F2A category back in 2022. She recently received her interview appointment at the Montreal Consulate for the end of October. In the meantime, we ve just welcomed our first child.
Does anyone know how I can add my newborn as a derivative beneficiary to the case? Also, if you have experience with this, could you share the correct email addresses or contacts at the NVC/Consulate where I should send the request?
Many thanks for anyone that might have some insight on this.

3 RepliesI submitted my i751 a week ago and received my receipt and biometrics appointment date.
However, I noticed that my DOB was incorrect for the online access part, and then checked the submitted form. The year had a typo and was wrong (last digit was supposed to be 2, but I put 4).
What should I do? I am so worried that this will affect my case negatively. Should I submit something online, or wait for the appointment and discuss it there?

7 RepliesPD 17 Dec 24 K-3: 5 March 25 California Center.
This morning, while at work, my wife received a text message from USCIS letting her know that she would receive a call in 30 minutes. She checked the number and it was legit.
Few minutes later, she received the call and a lady started questioning her about both petitions (K-3 and I-130). She asked her why she has 2 petitions in her file? Country where am i living, my date of birth, marriage date..etc.. She went to specific information but nothing bad at all except she was not aware of that to be well prepared.
Since we are not familiar with this and we would like hear your opinion regarding this random call.
1- Did anyone experience that before? non informed or random call or a last minute call?
2- According to your experience, what could be the meaning? suspicion of fraud? OR (to be positive) a sign that they are working on my- petitions and a decision is expected soon?
